Dismissal of an appeal against non-determination of an application of 150 houses by Bracknell Forest Council, will protect the setting of St Michael’s church, Sandhurst, a grade II* listed building. An inspector ruled that the proposals were harmful to the character of the area. The decision is significant as this was not an emerging local plan site. Partial costs were also awarded to the Council, as the appellant submitted a revised development description of the application on the fifth day of the five-day public inquiry, and the inspector criticised this behaviour. The earlier non-determination arose from insufficient information being supplied to the Council by the applicant within the timescale for consideration of the application.
